CARTAPEX SA (PTY) LTD – TERMS OF SERVICE

Effective Date: 18 June 2026

1. COMPANY INFORMATION

CartApex SA (Pty) Ltd (“CartApex SA”, “we”, “us” or “our”) is a South African supplier of:

  • Golf Cart Lithium Batteries
  • Golf Cart Tyres
  • Golf Cart Mags
  • Golf Cart Seat Covers
  • Golf Cart Upholstery
  • Golf Cart Accessories

By using our website or purchasing products from us, you agree to these Terms of Service.

CartApex SA (Pty) Ltd is not VAT registered. All prices are displayed in South African Rand (ZAR) and no VAT is charged.

2. PRODUCTS

All products are subject to availability. We reserve the right to:

  • Discontinue products
  • Amend specifications
  • Adjust pricing without prior notice

Product images are for illustration purposes only and may differ slightly from actual products supplied.

3. PRICING

All prices are displayed in South African Rand (ZAR). Prices are subject to change without notice. In the event of a pricing error, CartApex SA (Pty) Ltd reserves the right to cancel the order and refund any payments received.

4. PAYMENT

Orders will only be processed once payment has been received in full and cleared. Ownership of goods remains with CartApex SA (Pty) Ltd until payment has been received in full.

5. PRODUCT COMPATIBILITY (IMPORTANT)

Customers are responsible for ensuring compatibility of products with their golf cart, including:

  • Battery voltage
  • Battery dimensions
  • Charger compatibility
  • Controller compatibility
  • Motor compatibility
  • Tyre size
  • Rim size and fitment

CartApex SA (Pty) Ltd accepts no liability for damage caused by incompatible equipment or incorrect installation.

6. INSTALLATION RESPONSIBILITY

All electrical products, especially lithium batteries, must be installed by a qualified technician. CartApex SA (Pty) Ltd is not liable for:

  • Incorrect installation
  • Wiring errors
  • Product misuse
  • Unauthorised modifications
  • Incorrect system configuration

Installation constitutes acceptance of these conditions.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, CartApex SA (Pty) Ltd shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Loss of profits
  • Loss of income
  • Loss of business opportunities

Our maximum liability shall not exceed the purchase price paid for the product.

8. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

9. CONSUMER PROTECTION ACT

Nothing in these Terms limits any rights under the Consumer Protection Act 68 of 2008. Where any provision conflicts with applicable law, the law shall prevail.
